Although we attempt to avoid guardianship, sometimes it is necessary. A guardian is a person who is legally responsible for managing the affairs of an incapacitated person. A person can formally become a guardian only if appointed by the court. The process is controlled by state law.

A Power of Attorney is a written authorization to represent or act on another's behalf in private affairs, business, or other legal matters. A POS is a legal status granted by the court to somebody that allows them to act on someone's behalf.
